Terms of Use

The short version. Play fair, be aware of your surroundings while acting, and have fun. Kazoo Pro is an optional auto-renewing subscription billed through Apple that you can cancel anytime in your App Store settings. The AI's guesses are just for entertainment. The App is provided "as is."

These Terms of Use ("Terms") form an agreement between you and Octag AI LLC ("we," "us," or "our") governing your use of the Kazoo Charades vs AI app (the "App"). By downloading or using the App, you agree to these Terms. If you don't agree, please don't use the App.

The App and your license

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial entertainment, in line with these Terms and the Apple App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or distribute the App except as allowed by law.

Kazoo Pro subscriptions

Kazoo offers an optional auto-renewing subscription, Kazoo Pro, which unlocks premium decks, the Time Attack mode, and an ad-free experience.

Billing. Payment is charged to your Apple ID at confirmation of purchase. Kazoo Pro is offered on a weekly, monthly, or yearly basis at the prices shown in the App.
Auto-renewal. Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
Free trials. If a free trial is offered and you don't cancel before it ends, it automatically converts to a paid subscription. Any unused portion of a free trial is forfeited if you purchase a subscription.
Manage or cancel. Manage or cancel anytime in your Apple ID settings (Settings → your name → Subscriptions). Deleting the App does not cancel your subscription.
Payments & refunds. Purchases are processed by Apple and are subject to Apple's terms; refunds are handled by Apple under its policies.

Acceptable use

Play fair and be kind. You agree not to misuse the App, interfere with its operation, bypass security or purchase requirements, or use it for any unlawful purpose. You're responsible for playing safely and being aware of your surroundings and the people around you when acting out words.

AI-generated content

Kazoo's guesses are produced automatically by an AI model and are provided for entertainment only. They may be wrong, unexpected, or imperfect, and shouldn't be relied on for any purpose beyond playing the game.

Camera and microphone

Some modes use your front camera and/or microphone so the App can play — for example, so the AI can "see" you act or "hear" guesses. You control these permissions in your device Settings. How this information is handled is described in our Privacy Policy.

Intellectual property

The App — including its name, mascot, design, text, graphics, and software — is owned by Octag AI LLC or its licensors and is protected by intellectual-property laws. These Terms don't grant you any rights in our trademarks or content beyond the limited license to use the App.

Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the App will be uninterrupted, error-free, or that AI guesses will be accurate.

Limitation of liability

To the fullest extent permitted by law, Octag AI LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the 12 months before the claim (or, if you paid nothing, USD $50).

Indemnification

You agree to indemnify and hold harmless Octag AI LLC from claims, damages, and expenses arising out of your misuse of the App or violation of these Terms.

Changes to the App and these Terms

We may update, change, or discontinue parts of the App at any time. We may also update these Terms; when we do, we'll revise the "Last updated" date. Continued use after changes means you accept the updated Terms.

Termination

You may stop using the App at any time. We may suspend or end your access if you violate these Terms or misuse the App.

Apple App Store

You acknowledge that these Terms are between you and Octag AI LLC only — not Apple — and that Apple is not responsible for the App or its content. Your license to use the App is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. Octag AI LLC, not Apple, is solely responsible for the App and for any maintenance and support. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Octag AI LLC, not Apple, is responsible for addressing any claims relating to the App (including product-liability, legal or regulatory, and intellectual-property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the United States and the state in which Octag AI LLC is organized, without regard to conflict-of-laws rules. Disputes will be handled in the courts located there, unless applicable law provides otherwise.
